Terms of Service

These Terms of Service ("Terms") govern your use of the HearNow mobile application ("App") provided by HearNow ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Description of Services

HearNow is a text-to-speech application for iOS that allows you to:

  • Listen to text content — Import PDFs, web pages, documents, or typed text and have them read aloud using iOS system voices or premium AI voices.
  • AI Summarization — Generate summaries of your imported content using AI.
  • AI Podcast — Convert documents into podcast-style audio discussions using AI-generated voices.

AI features require sending content to our AI service providers (such as OpenAI and Google) to generate results. We select the most suitable model for each feature. We do not store this content on our servers—it is processed and immediately discarded.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Your Content

You retain ownership of all documents, text, and other content you import into the App ("Your Content"). By using AI features, you grant us a limited license to process Your Content solely to provide the requested service (summarization or podcast generation).

You represent that:

  • You have the right to use and process Your Content.
  • Your Content does not violate any applicable laws or third-party rights.
  • You will not use the App to process content that is illegal, harmful, or violates others' intellectual property rights.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse engineer, decompile, or extract source code from the App.
  • Circumvent usage limits, quotas, or security measures.
  • Use the App to generate content that is harmful, misleading, or violates third-party rights.
  • Resell, redistribute, or commercially exploit the App or its output without authorization.

5. Subscriptions and Payments

The App offers free features and optional premium subscriptions. Subscriptions are billed through the Apple App Store and are subject to Apple's terms and policies. Subscription prices are displayed in the App Store before purchase.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • You can manage or cancel subscriptions in your Apple ID account settings.
  • Refunds are handled exclusively by Apple. We cannot issue refunds for App Store purchases. To request a refund, contact Apple Support or use the "Report a Problem" feature in your purchase history.

6. AI-Generated Content

Content generated by AI features (summaries, podcasts, AI voices) is provided by our AI service providers (such as OpenAI and Google) and delivered "as is." AI output may contain errors, inaccuracies, or omissions. You are responsible for reviewing and verifying any AI-generated content before relying on it.

We do not guarantee that AI-generated content is accurate, complete, or suitable for any particular purpose. AI-generated content is subject to our providers' respective API terms.

7. Intellectual Property

The App, including its design, code, features, and branding, is owned by HearNow and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

AI voices and AI-generated content are provided by our AI service providers and are subject to their respective terms of service.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and share information.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We are not responsible for the accuracy, quality, or legality of Your Content or any content you access through the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARNOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the total amount you paid us for the App in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may stop using the App at any time by deleting it from your device.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page and may notify you through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
